He took the kids to his mother's and won't bring them back

We don't have a custody order yet. He took them on what I thought was a weekend trip 9 days ago. He says they're staying. Can I just go get them?

Without a court order, both parents have equal rights. The fastest move is an ex parte for emergency custody. Self-help center can walk you through filing the same day.
