Debt collector is calling my mom and brother

CAanon_collected1 month ago

A collector is calling my relatives about my debt. Some are saying things like 'tell her to pay or there will be consequences.' Legal?

No — that's an FDCPA violation, and probably several. Under federal law (Fair Debt Collection Practices Act), a collector can only contact third parties to LOCATE the debtor (ask for address/phone/employer), can only do that ONCE per third party, can't disclose that you owe a debt, and can't threaten consequences. CA's Rosenthal Act layers on more protections and covers original creditors too. Damages can include actual damages, statutory damages up to $1,000 per case, attorney fees. Document every call (date, who called whom, what was said). Many plaintiff FDCPA attorneys take these on full contingency because attorney fees are baked into the statute. You may end up the plaintiff here, not the defendant.
